These Terms of Service (“Terms”) govern your access to and use of the Outfame website at outfame.co and all related services (the “Service”) operated by Outfame Analytics, Inc. (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 13 years old (or 16 in the EEA) and that you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Outfame provides Instagram and social media analytics tools, including engagement rate calculators, follower tracking, audience insights, competitor analysis, best time to post recommendations, and growth reports. The Service analyzes publicly available social media data and data accessed through official platform APIs.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your information if it changes
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free and Paid Plans

The Service is available in free and paid tiers. Free accounts have limited functionality as described on our pricing page. Paid subscriptions are billed monthly or annually as selected at purchase.

• Payments are processed securely through Stripe
• Subscriptions auto-renew unless cancelled before the next billing cycle
• You may cancel at any time; access continues until the end of the current billing period
• We offer a 14-day money-back guarantee on paid plans
• Refund requests after 14 days are evaluated on a case-by-case basis

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Scrape, crawl, or use automated means to access the Service beyond API limits
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to harass, stalk, or harm another person
• Impersonate any person or entity
• Resell or redistribute the Service without our written permission
• Use analytics data to violate any third party’s privacy or intellectual property rights

6. Intellectual Property

The Service, including all content, features, functionality, software, and design, is owned by Outfame Analytics, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

You retain ownership of any data you upload or input into the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Third-Party Services

The Service integrates with third-party platforms including Instagram/Meta. Your use of these integrations is subject to the respective platforms’ terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. ANALYTICS DATA IS PROVIDED FOR INFORMATIONAL PURPOSES AND WE DO NOT GUARANTEE ITS ACCURACY OR COMPLETENESS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTFAME ANALYTICS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold Outfame Analytics, Inc. harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, or infringement of any third party’s rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations and indemnification) will survive.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance. If you disagree with updated Terms, you must stop using the Service.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco, California.
